Congresswoman Pramila Jayapal (D, WA) interjected into a House hearing on contempt for President Joe Biden’s crackhead son Hunter Biden, saying, “Trump incited an erection” rather than “insurrection.”
After being laughed at, she added “Maybe we should talk about that too. Maybe we should talk about the fact that the former president was convicted on 91 felony counts” (emphasis added).
The congresswoman’s misstatements, even if not Freudian, inadvertently disclosed her focus on the Democrats’ campaign strategy for the 2024 election: change any mention of the Biden family corruption into misstatements about President Trump’s being “convicted” of 91 “counts,” when the truth is he has not been “convicted” of any crimes.
The discussion, in the limited space herein, will be limited to the 41 filed in Fulton County, Georgia, against Trump, and 18 others, for trying to ensure an accurate vote count for the 2020 election.
Why was the DOJ not interested?
Some of the counts allege violations of Georgia’s RICO (Racketeer Influenced and Corrupt Organization) Act. A person must engage in a pattern of racketeering activity connected to an enterprise, such as gambling, murder, kidnapping, arson, drug dealing, bribery, and mail or wire fraud to violate RICO.
Some of the counts allege conspiracy, which is when two or more persons form an agreement to violate the law, and then act on the agreement.
The “Criminal” Counts
The defendants, besides Donald Trump, are (I assigned the numbers for convenience):
1) Rudy Giuliani (13 counts). One of Trump’s personal attorneys who provided legal advice to the president.
2) John Eastman (9 counts). A former Trump election lawyer.
3) Mark Meadows (2 counts). An attorney who was serving as The Chief of Staff to the president.
4) Kenneth Cheesbro (7 counts). An attorney who provided advice on Constitutional issues.
5) Jeffrey Clark (2 counts). A DOJ official during the Trump presidency.
6) Jenna Ellis (2 counts). Legal adviser to Trump in his election campaign.
7) Ray Smith III (12 counts). Georgia lawyer who provided election related advice.
8) Robert Cheeley (10 counts). Georgia lawyer who allegedly made false statements regarding fraud.
9) Michael Roman (7 counts). Trump staff member who met with electors.
10) David Shafer (8 counts). Former Georgia GOP chair.
11) Shawn Still (7 counts). A businessman who became a state senator in Georgia.
12) Stephen Lee (5 counts). A pastor from Illinois who served as an election worker in Georgia.
13) Trevian Kutti (3 counts). Former publicist for rappers R. Kelly and Kanye West and a long-time friend of Trump who traveled to Georgia on Jan 4, 2021.
14) Harrison Floyd (3 counts). He is associated with the organization of Black Voices for Trump.
15) Sidney Powell (7 counts). A former Trump attorney.
16) Cathleen Latham (11 counts). Former Coffee County GOP chair.
17) Scott Hampton (7 counts). Elections director in Coffee County.
18 Michael Roman (7 counts). Former Trump campaign official.
Making Life Difficult for Defendants
What is the effect of charging such a large, diverse group of professionals?
Each of these professionals will have their employment negatively affected, their families suffer the humiliation and expense of paying for lawyers as their credit may be frozen, as happened to one of my clients.
Why do this?
I call it the “War of Attrition,” where the hope is that one, or more, will plea bargain to testify against Trump in exchange for not being prosecuted. The fact that none of the 18 have done this is a good indicator that all of them, including Trump, are not guilty.
What about the prosecutors?
The Soros-sponsored DA Fani Willis life was not negatively affected: until now.
Defendant 18, Mike Roman, filed a motion to disqualify Fani Willis and Nathan Wade, the Special Prosecutor she hired with taxpayer money but without obtaining the required approval.
An Alleged Love Affair
The facts are developing to potentially charge both Willis and Wade with the conspiracy of Willis paying Wade, and then Wade “kicking back” some by taking Willis on elaborate vacations to Hawaii and the Caribbean.
Willis has been subpoenaed in Wade’s wife’s divorce action.
The potential conspiracy may well include one or more members of the Jan 6 committee, as Willis met with them in April 2022 to review, but not keep evidence before she convened a grand jury the next month and continued to communicate with the committee.
Was this information shared with the defense?
The Jan 6 committee did share its evidence with the DOJ for use in prosecuting thousands of Trump supporters, before Speaker Pelosi ordered the committees’ evidence – obtained with taxpayers’ money – destroyed, to prevent defense counsel from using the exculpatory evidence.
Could this be a conspiracy or RICO case?
Or, is mishandling public records, as done by Biden, or destroying them, as done by Pelosi, only a crime if done by Trump?
Willis has declined to answer Congressman’s Jim Jordan’s request for disclosure of her contacts with the Jan 6 committee.
Criminal Charges Filed Against Fani Willis
Similarly, a potential conspiracy may well include one, or more, members of the White House, including White House Counsel, based on Willis and Wade’s visits, for which he billed the case for his eight-hour days at the White House.
Willis’s response condemns her race and gender with ‘You cannot expect Black Women to be perfect.”
Congresswoman Marjorie Green (R, GA) has filed criminal charges against Willis with the Georgia governor and attorney general.
A judge has scheduled a hearing in February for the charges against Willis and Wade.
The House Judiciary Committee has opened an investigation into Willis’s love interests and Wade’s political prosecution of Trump.
A Georgia senator is trying to remove the head of elections, Brad Raffensberger, for the same irregularities that the Trump group is being criminally charged for.
Meanwhile, despite the DOJ still searching for people to charge for Jan 6 and continuing to show no interest in the events in Georgia, there may yet be justice in Georgia for Trump and others.
And justice may be served by a conviction of Fani Willis too.
